اقتدار قانون کیفری مبتنی بر ارزش های اجتماعی در پرتو اعتماد؛ درنگی روانشناسانه بر پایه تئوری انتخاب

چکیده

جرم انگاری بر پایه ارزش‌های اجتماعی منجر به جلب اعتماد مردم به قوانین و واضعان آن می گردد و اطاعت از آن قوانین را به همراه دارد. در این بین، پرسش اساسی این است که مکانیسم این گونه از جرم انگاری، در فرایند شکل گیری اعتماد و کنترل جرم چگونه است؟ در این زمینه استفاده از یافته های علم روانشناسی می تواند راه گشا باشد. یکی از نظریه های مطروح در روان شناسی، تئوری انتخاب است. نوشتار حاضر با بکارگیری روش توصیفی-تحلیلی به این نتیجه رسیده است که تئوری مذکور قادر است با تبیین نحوه شکل گیری رفتار و شناخت عوامل دخیل در آن، با توضیح نحوه ورود قانون‌گذار و قانون کیفری به دنیای مطلوب شهروندان از طریق توجه به تصاویر موجود در این دنیا، به شکل گیری یک رابطه مبتنی بر اعتماد و اطاعت بین قانون گذار و مخاطب آن منجر گردد که می تواند مبنای نظری فرضیه کاهش جرم در اثر جرم‌انگاری مبتنی بر ارزش‌های اجتماعی و جلب اعتماد مخاطبین قانون باشد و آن را تقویت نماید.

چکیده [English]

Criminalization based on social values leads to gaining the public's trust in the laws and their creators and their creators and leads to obedience to those laws. The fundamental question, however, is how does the mechanism of such criminalization influence the process of trust formation and crime control? In this regard, findings from the field of psychology can be insightful. One of the proposed theories in psychology is Choice Theory. This study, using a descriptive-analytical method, concludes that the aforementioned theory can explain the formation of behavior and the factors involved in it. By illustrating how the legislator and criminal law enter the quality world of citizens through attention to the images in this world, a relationship based on trust and compliance between the legislator and its audience can be established. This could serve as the theoretical foundation for the hypothesis that crime can be reduced through criminalization based on social values, thereby strengthening the trust of the law's audience.
