Sentencing is one of the fundamental pillars of criminal policy that influences the determination of the type and severity of punishment, particularly with regard to legal persons. This study, using a descriptive-analytical method and based on library resources, examines the governing criteria for sentencing in various criminal justice systems. In this regard, principles such as the proportionality of crime and punishment, fixed and determined penalties, individualized sentencing, and sentencing guidelines in relation to legal persons are analyzed.
The findings of the research indicate that, in Iran’s legal system, due to the novelty of the subject and the prevailing traditional approach to punishment as well as the spirit of individualism dominant in domestic criminal laws, a crime-centered approach governs the sentencing process for legal persons. In contrast, a comparative analysis with other legal systems shows that the legal system of England, by moving away from the crime-centered approach, has adopted other sentencing models, such as the guideline-based model.
