A Critical Analysis of Iranian Criminal Law on Temporary Detention with a view to French Law

Abstract

Given that the pre-trial detention regime must strike a balance between the effectiveness of punishment and the protection of personal liberty, examining the shortcomings and ambiguities in existing laws, offering suggestions, and comparing legal provisions in Iranian law with French law to identify successful precedents is undoubtedly beneficial. This study critically evaluates the level of protection provided by law against deprivation of liberty and, using a descriptive-analytical method, seeks to answer to what extent the substantive and procedural features of the law have been successful in limiting cases of detention. Therefore, while examining the existing shortcomings in the laws and comparing legal provisions in Iranian law with French law, suggestions are presented to identify successful approaches. Ultimately, it is argued that in the realm of temporary detention, a review of legal articles and increased oversight during the detention issuance phase is necessary.
