Abstract
The International Criminal Court can be seen as an efficient beginning in the fight against the most terrifying criminals and the impunity of the most professional criminals. However, some countries, including Iran, have not yet joined this court. Among the challenges facing the realization of this valuable event is the disharmony of countries, especially Islamic countries, with the world's popular understanding of fundamental concepts such as peace, justice, dignity, equality, etc. Therefore, according to the authors, at the present time, a universal understanding of the mentioned concepts should be accepted. In this regard, in order to strengthen this idea, one of the important foundations of which is the “Cosmopolitanism” theory, from arguments such as “the necessity of striving for the formation of a better world”, “globalized criminal law”, “the overlap of the goals of domestic law and the International Criminal Court”, “Sharia validity of aligning with the surrounding world” and finally “Applying the Maqasid Shariah (purposes of Sharia)” can be used.
