هم‌آوایی با برداشت جهانی از مفاهیم بنیادی بشری؛ رویکردی کارآمد در راستای پیوستن ایران به دیوان کیفری بین‌المللی

چکیده

دیوان کیفری بین‌المللی را می‌توان آغازگَهی جریان‌ساز در مسیر پیکار با هراس‌انگیزترین بزه‌ها و بی‌کیفرمانی جورپیشه‌ترین بزه‌کاران دانست. با این‌همه، تا به امروز پیوستن برخی کشورها مانند ایران به این بارگهِ داد انجام نشده است. ازجمله چالش‌های پیش‌روی تحقق این رخداد شایان و باارزش، ناهمسویی کشورها، به‌ویژه کشورهای اسلامی، با برداشت پسندیده جهانیان از مفاهیم بنیادی همچون صلح، عدالت، کرامت، برابری و... است و تا این هم‌آوایی انجام نپذیرد، این رویداد رخ نمی‌دهد. ازاین‌رو، به باور نگارندگان بایستی در زمانه کنونی برداشت جهانی از مفاهیم یادشده را پذیرفت. دراین‌باره، برای قوام‌بخشیدن به این اندیشه که یکی از مبانی برجسته و اساسی آن نظریه «جهان‌میهنی» است، می‌توان از ادله‌ای همچون «ضرورت تلاش برای شکل‌گیری جهانی بهتر»، «حقوق کیفری جهانی‌شده»، «همپوشانیِ اهداف حقوق داخلی و دیوان کیفری بین‌المللی»، «اعتبار دینی همسویی با جهانِ پیرامون» و سرانجام «کاربست مقاصد شریعت» سود جست.

چکیده [English]

The International Criminal Court can be seen as an efficient beginning in the fight against the most terrifying criminals and the impunity of the most professional criminals. However, some countries, including Iran, have not yet joined this court. Among the challenges facing the realization of this valuable event is the disharmony of countries, especially Islamic countries, with the world's popular understanding of fundamental concepts such as peace, justice, dignity, equality, etc. Therefore, according to the authors, at the present time, a universal understanding of the mentioned concepts should be accepted. In this regard, in order to strengthen this idea, one of the important foundations of which is the “Cosmopolitanism” theory, from arguments such as “the necessity of striving for the formation of a better world”, “globalized criminal law”, “the overlap of the goals of domestic law and the International Criminal Court”, “Sharia validity of aligning with the surrounding world” and finally “Applying the Maqasid Shariah (purposes of Sharia)” can be used.
