دانشگاه گیلان (با مشارکت انجمن ایرانی حقوق جزا) پژوهشنامه حقوق کیفری 2322-2328 17 1 2026 06 22 Legal Requirements and Jurisprudential Teachings on the Protection of Women Victims of Marital Rape بایسته های حقوقی و آموزه های فقهی نحوه حمایت از زنان قربانی تجاوز در نهاد ازدواج 71 86 9350 10.22124/jol.2025.29646.2564 FA امیر سماواتی پیروز استادیار گروه حقوق، دانشکده تمدن و مطالعات جهان، دانشگاه آزاد اسلامی واحد کرج، کرج، ایران حسن بیگدلی دانشجوی دکتری حقوق کیفری و جرم شناسی دانشکده تمدن و مطالعات جهان، دانشگاه آزاد اسلامی واحد کرج، کرج، ایران. 0000-0003-3335-9071 Journal Article 2025 01 22 Marital rape,from the perspectives of criminal law and criminology,is a multifaceted and complex phenomenon that requires a simultaneous examination from jurisprudential(Fiqhi),legal,and social viewpoints.From a social standpoint,women are often coerced into unwanted sexual acts within maritalrelations without their free consent—a reality whose nature is in no way justifiable by the marital bond.On the other hand,the jurisprudential doctrines of both Imamiyyah and Sunni criminal jurisprudence regard maritalrape as aclear instance of inflicting harm(Iza'aGhayr)and a forbidden(Haram)act.Using a comparative and analytical approach,this study identifies the main obstacles to criminalizing maritalrape in Iran as the lack of a specific criminal definition,traditional interpretations,and the absence of appropriate criminal sanctions.Implementation challenges—such as the difficulty of proving the offense,deep-rooted cultural barriers,and the lack of unified judicial procedures—arealso among the limiting factors in confronting this phenomenon.The research emphasizes the necessity of a fundamental revision in Iran's criminal policy,grounded in both jurisprudential teachings and human rights principles. تجاوز در نهاد ازدواج، از دیدگاه حقوق‌کیفری و جرم‎شناسی، پدیده‎ای چندجانبه و پیچیده است که باید با نگرشی توأمان و از‌ منظر فقهی،‌ حقوقی و اجتماعی بررسی شود. از جنبه اجتماعی، زنان در بسیاری از موارد بدون ‌رضایت‌آزادانه در چارچوب روابط‌ زناشویی، به اعمال جنسی ناخواسته مجبور می‌شوند که ماهیت آن به‌هیچ‌وجه توسط رابطه زوجیت قابل توجیه نیست. از‌سوی‌دیگر، آموزه‌های فقه جزایی امامیه و عامه، تجاوز در نهاد ازدواج را مصداق بارز ایذاءغیر و عملی حرام می‌دانند. پژوهش حاضر با رویکردی تطبیقی و تحلیلی، موانع اصلی جرم‌انگاری تجاوز زناشویی در ایران را فقدان تعریف کیفری مشخص، تفاسیر سنتی و نبود ضمانت اجرای کیفری مناسب می‌داند. چالش‎های اجرایی نظیر دشواری اثبات جرم، موانع فرهنگی عمیق و فقدان رویه‌های قضایی واحد نیز از عوامل محدودکننده مقابله با این پدیده هستند. این پژوهش بر لزوم بازنگری‌اساسی در سیاست‎گذاری‌کیفری ایران متکی بر آموزه‌های فقهی و حقوق بشری تأکید دارد. https://jol.guilan.ac.ir/article_9350_1f7fb18b2e15794d85db7b804950c660.pdf
