Journal Article 2024 12 16 The media has the right to cover criminal incidents in light of the principle of freedom of expression. The consequence of this coverage is the public's judgment of the case, which, under the influence of media indoctrination—outside the judicial process and regardless of the presence or absence of sufficient and credible evidence against the accused—proceeds to try and convict the accused.<br />The present research was conducted using a descriptive-analytical method, utilizing library resources and a critique and analysis of legal materials and notable cases. Its goal is to identify a mechanism that protects the defendant's right to a fair trial while guaranteeing the media's right to freedom of expression.<br />The research findings show that a fair trial is an absolute and inviolable right that should be preferred to the public's right to information; therefore, it is proposed to amend Articles 96 and 352 of the Criminal Procedure Code and determine legal mechanisms that restrict media freedom in the realm of legal and judicial issues, and in parallel, organize the publication of judicial news by the spokesperson for the judiciary. رسانه‌ها در پرتو اصل آزادی بیان حق دارند حوادث جنایی را پوشش دهند. پیامد این پوشش، قضاوت افکار عمومی در خصوص پرونده است که تحت‌تأثیر القای رسانه‌ها خارج از فرایند رسیدگی قضایی و بی‌توجه به وجود یا فقدان دلایل اثباتی کافی و معتبر علیه متهم، اقدام به محاکمه و محکومیت متهم می‌کند. <br />پژوهش حاضر به روش توصیفی- تحلیلی و با استفاده از منابع کتابخانه‌ای و نقد و تحلیل مواد قانونی و پرونده های مشهور انجام شده است و هدف آن، یافتن ساز و کاری جهت حمایت از حق متهم در برخورداری از دادرسی عادلانه، در عین تضمین حق آزادی بیان رسانه ها است. <br />یافته های پژوهش نشان می‌دهد دادرسی عادلانه، حقی مطلق و خدشه‌ناپذیر است که باید بر حق آگاهی عموم ترجیح داده شود؛ بنابراین اصلاح مواد 96 و352 قانون آیین دادرسی کیفری و تعیین سازوکارهای قانونی محدودکننده آزادی رسانه‌ها در قلمرو مسائل حقوقی و قضایی و به‌موازات آن ساماندهی انتشار اخبار قضایی از سوی سخنگوی قوه قضائیه پیشنهاد شده است. https://jol.guilan.ac.ir/article_9158_9308e8f866eeca04298634e65fe7c0e9.pdf
