German legislator (in the form of article 21th of the German penal code) pays full attention to the issue of diminished Criminal Responsibility due to non-psychotic disorders. The criminal codes after the Islamic revolution of Iran, including the Islamic penal code of 1392, in comparison with the criminal codes before the Islamic revolution, have had a regressive course in the issue of diminished criminal responsibility. Anticipating the diminished criminal responsibility in the case of criminals with non-psychotic disorders in Ta’azirat punishments and thinking about solutions regarding the punishments of Hodoud and Qisas should be followed seriously. در این مقاله با روشی توصیفی-تحلیلی، به مقایسه وضعیت نظام حقوق کیفری ایران و قانون مجازات آلمان در خصوص مسئولیت کیفری کاهش‌یافته ناشی از اختلالات روانی نسبی پرداخته شده است. «مسئولیت کیفری کاهش‌یافته» قسمی از مسئولیت است که در میانه مسئولیت کیفری کامل و فقدان مسئولیت جزایی قرار می‌گیرد و از جمله در مواردی که اختلالات روانی به «نقصان» قوه تشخیص و قدرت کنترلِ مرتکب جرم می‌انجامند، اعمال می‌شود. در حالی‌که قانونگذار آلمانی (در قالب ماده 21 قانون مجازات آلمان)، به موضوع مسئولیت کیفری کاهش‌یافته ناشی از اختلالات روانی نسبی توجه کامل دارد، قوانین کیفری پس از انقلاب اسلامی در ایران، از جمله ق.م.ا. 1392، در موضوع مسئولیت کیفری کاهش‌یافته ناشی از اختلالات روانی، در مقایسه با قوانین پیش از انقلاب اسلامی، سیری قهقرایی داشته‌اند. پیش‌بینی مسئولیت کیفری کاهش‌یافته در مورد مجرمان مبتلا به اختلالات روانی نسبی، در مجازات‌های تعزیری و چاره‌اندیشی در باب مجازات‌های حدود و قصاص، از جمله استفاده از ظرفیت قاعده درأ، راهکاری است که باید با جدیت دنبال شود. https://jol.guilan.ac.ir/article_8895_113b28ef941f968a1d72d4163f043577.pdf
