The Islamic punishment law, approved in 1392 (2013) considers these grounds to be confession, witnessing, oath, vows, and judge’s knowledge.  As we know, among proving grounds, confessions have special standing to the extent that it is called the “queen” of legal reasons, such that as soon as there is a confession, the judge is required to issue his verdict based on it.  In the present article, considering the Islamic punishment law of 1392 (2013) we attempt to determine the position of the judge’s knowledge in proving criminal matters, and whether we can consider it the “higher reason” or the “queen” of reasons.  Is there a reason that has a higher position among criminal proving grounds?  The results of the analyses indicate that for the first time, in the Islamic punishment law of 1392 (2013), while keeping the proof value of the other grounds, the legislator has considered judge’s knowledge in a higher position than the other criminal grounds including confession and witnessing.}, keywords = {Criminal reasons,Judge’s knowledge,Confession,witnessing,Queen of reasons}, title_fa = {جایگاه علم قاضی در اثبات امر کیفری در حقوق ایران}, abstract_fa = {یکی از مهمترین مباحث حقوق کیفری که تأثیر بسزایی در تحقق عدالت قضایی دارد مبحث راجع به ادله اثبات است که لازم است مقنن احکام آن را با صراحت و شفافیت بیشتر بیان دارد. قانون مجازات اسلامی مصوب 1392 این ادله را عبارت از اقرار، شهادت، قسامه، سوگند و علم قاضی دانسته است. می‌دانیم که در میان ادله اثبات امر حقوقی، اقرار از جایگاه ویژه‌ای برخوردار است تا حدی که اصطلاحاً ملکه دلایل حقوقی گفته می‌شود به نحوی که به محض وقوع اقرار، قاضی محکمه حقوقی مکلف به صدور حکم براساس آن است. در مقاله حاضر در صدد هستیم تا با توجه به نوآوری­های مقنن در قانون مجازات اسلامی (1392) در مبحث مربوط به ادله اثبات، جایگاه علم قاضی در اثبات امر کیفری را از طریق مقایسه آن با سایر ادله و تبیین شرط بیّن بودن، مورد بررسی قرار دهیم. نتیجه بررسی‌ها حکایت از آن دارد که مقنن برای نخستین بار و در قانون مجازات اسلامی (1392) در شرایطی و با حفظ ارزش اثباتی سایر ادله، علم بیّن قاضی را دارای جایگاه برتر از سایر دلایل کیفری از جمله اقرار و شهادت، دانسته است.}, keywords_fa = {دلایل کیفری,علم قاضی,اقرار,شهادت,ملکه دلایل}, url = {https://jol.guilan.ac.ir/article_3889.html}, eprint = {https://jol.guilan.ac.ir/article_3889_58f4a21ac5b3738c1d83c14032fda7cd.pdf} }
